Federal Judge Vacates National Eviction Ban; County Remains Under State Emergency Order

A federal judge last week vacated a nationwide freeze on evictions that was put in place by the Centers for Disease Control and Prevention [CDC] to help cash-strapped renters remain in their homes during the pandemic. Local leaders say this decision is “extremely concerning.”

“We’re hoping that the President issues the order under an agency that has the authority to do this because the judge didn’t rule that it couldn’t be done, simply that the agency that did it – did not have the authority,” said Montgomery County Executive Marc Elrich.

In the meantime, the county remains under the state’s Executive Order to protect tenants in need.
